1. Who we are

AsthmaStats is operated by AsthmaStats, [YOUR LEGAL STATUS — e.g. a sole trader based in England, or a company registered in England and Wales with company number NNNNNNNN]. Contact us at support@asthmastats.com.

2. What the service is

We provide a website where you can record health readings and view them back as tables, charts and a printable summary. It is a record-keeping tool. It is not a medical device, does not give medical advice, and does not replace care from a healthcare professional. Please read the medical disclaimer, which forms part of these terms.

3. Your account

You must be 16 or over to hold an account. Keep your password to yourself and use one you do not use elsewhere. Tell us promptly if you think someone else has access to your account. You are responsible for what happens under your account.

You may record readings on behalf of a child you are responsible for, or another person who has asked you to, provided you have their agreement.

4. Your data belongs to you

Your readings are yours. We claim no ownership of them and will not use them for any purpose beyond showing them back to you, as set out in the privacy policy. You can export everything or delete your account at any time from your account page.

5. Acceptable use

You agree not to:

  • attempt to access anyone else's account or readings;
  • probe, scan or test the security of the service, or interfere with its operation;
  • use automated means to create accounts or submit readings at scale;
  • use the service to store anything unlawful, or in a way that breaks the law.

We may suspend or close an account that does any of these.

6. Availability

We aim to keep the service running but do not guarantee it will always be available or uninterrupted. We may change, suspend or withdraw features. If we ever decide to shut the service down, we will give you at least [NUMBER] days' notice by email so you can export your data first.

Please keep your own copy of anything you cannot afford to lose. The export feature is there for exactly that.

7. Cost

The service is currently free. If we ever introduce charges, existing accounts will be told by email well in advance and will never be charged without agreeing first.

8. Our liability

We provide the service as it is, without warranties. To the extent the law allows, we are not liable for any loss arising from your use of it, including any decision you take about your health. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.

If you are a consumer, you keep all your statutory rights, and nothing here affects them.

9. Closing your account

You can delete your account at any time from your account page. Deletion is immediate and permanent — we cannot recover anything afterwards. We may close an account that breaks these terms, and will normally give you notice and a chance to export your data first.

10. Changes to these terms

We may update these terms. If a change materially affects you we will email you before it takes effect. Continuing to use the service after that means you accept the updated terms.

11. Law

These terms are governed by the law of England and Wales, and disputes are subject to the courts of England and Wales. If you live in Scotland or Northern Ireland you may also bring proceedings in your own courts.
